Our Services

Motion Lab provides professional motion capture services for the game development industry, specifically focusing on arcade game animation. Our services include but are not limited to:

• Full-body motion capture sessions using optical tracking technology
• Facial performance capture and expression tracking
• Animation retargeting to custom character models
• Motion data cleanup and processing for game engines
• Technical consultation and pipeline integration support

Service specifications, pricing, and availability are subject to change. We reserve the right to modify or discontinue services with reasonable notice to existing clients.

Acceptable Use Policy

When using our website and services, you agree to use them only for lawful purposes and in ways that do not infringe the rights of others or restrict their use and enjoyment of our services.

Client Accounts and Service Access

• Represent a legitimate business entity for commercial bookings

Account Security

You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach. We are not liable for losses resulting from unauthorized account access that you fail to report promptly.

Account Termination

We reserve the right to suspend or terminate access to our services for accounts that:

Service Availability and Modifications

Uptime and Maintenance

While we strive to maintain uninterrupted service availability, we do not guarantee that our website or booking systems will be available at all times. Studio Booking and Scheduling

Motion capture sessions are subject to studio availability and must be booked in advance. Confirmed bookings may be rescheduled due to equipment issues, performer availability, or other unforeseen circumstances. We'll work with you to find alternative session times that accommodate your project timeline.

Service Modifications

Motion Lab reserves the right to modify, update, or discontinue any aspect of our services at any time. This includes changing pricing, service offerings, technical specifications, or operational procedures. We'll provide reasonable notice to clients with active projects before implementing changes that significantly affect service delivery.

Geographic Restrictions

Our physical studio services are provided from our Burbank, California location. While we accept clients from anywhere, on-site capture sessions require travel to our facility. Remote services may have geographic limitations based on technical requirements and time zone considerations.

Payment and Pricing

Pricing for our services is provided in US dollars and is subject to change. All quotes are valid for 30 days unless otherwise specified. Payment terms are established at the time of booking and may include:

• Deposit requirements to secure studio booking dates
• Milestone-based payments for larger projects
• Full payment prior to session start for first-time clients
• Net-30 terms for established clients with approved credit

Late payments may incur additional fees. Unpaid invoices may result in suspension of services and delivery of captured data. All prices exclude applicable sales tax unless otherwise noted.

Intellectual Property Rights

Our Content

All content on our website, including text, images, videos, logos, and design elements, is owned by Motion Lab or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

Client-Provided Content

When you provide us with character models, specifications, or other materials for your project, you retain ownership of that content. By providing these materials, you grant us a limited license to use them solely for the purpose of delivering the requested services.

Captured Motion Data

Upon full payment, you receive a non-exclusive license to use the motion capture data we create for your project. This license allows you to use the data in your game or application as specified in your service agreement. We retain the right to use generic motion data for demonstration purposes and future projects unless otherwise agreed in writing.

Trademarks

Motion Lab and our logo are trademarks of Motion Lab. You may not use our trademarks without prior written consent. Other product and company names mentioned on our website may be trademarks of their respective owners.

Confidentiality

We understand that game development projects often involve confidential information. We agree to maintain confidentiality of your project details, character designs, and other proprietary information shared with us during service delivery. Our team members and contractors sign non-disclosure agreements covering client projects.

If you require additional confidentiality provisions, we can execute a mutual non-disclosure agreement before project commencement. Please discuss your confidentiality needs with us when booking services.

Cancellation and Refunds

Session cancellations must be made at least 48 hours before the scheduled start time to receive a full refund of any deposit. Cancellations made within 48 hours may forfeit the deposit or incur a cancellation fee. No-shows without prior notice forfeit all payments.

For multi-session projects, partial refunds may be available for unused sessions if cancellation occurs before work begins. Once motion capture sessions are completed, payments are non-refundable as the service has been delivered.

Limitation of Liability

Motion Lab provides motion capture services on an as-is basis. While we strive for excellence, we cannot guarantee that captured data will meet all your technical requirements or be error-free. Our liability is limited to the amount you paid for the specific services in question.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption arising from use of our services. This limitation applies even if we've been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold Motion Lab harmless from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of third-party rights. This includes reasonable attorney fees and costs incurred in defending against such claims.

Governing Law and Disputes

These Terms of Service are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services will be resolved in the state or federal courts located in Los Angeles County, California.

Before initiating formal legal proceedings, we encourage resolving disputes through good-faith negotiation. Many issues can be addressed through direct communication with our team.

Changes to These Terms

We may update these Terms of Service periodically to reflect changes in our business practices, legal requirements, or service offerings. When we make significant changes, we'll update the date at the top of this page and may notify active clients by email. Continued use of our services after changes take effect constitutes acceptance of the revised terms.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
